The Islamabad High Court has issued a ruling stating that illegal gatherings will
not be tolerated in the federal capital, particularly in light of the upcoming
Shanghai Cooperation Organization (SCO) Summit.
Chief Justice Aamir Farooq delivered the written order during a hearing plea
made by local businessmen regarding protests in Islamabad.
The court’s directive emphasises the importance of maintaining order during this
critical event, instructing the Islamabad administration and government to
designate appropriate areas for any protests.
“It is imperative to ensure that there is no protest or lockdown situation during
the SCO Summit,” the order stated.
While acknowledging the fundamental rights of assembly and movement
enshrined in Articles 16 and 17 of the Constitution, the court clarified that these
rights are subject to legal restrictions.
The court was informed that workers from a political party were planning to
march toward the red zone, a move that could obstruct the movement of other
citizens.
In light of these concerns, the Islamabad High Court mandated that adequate
measures be taken to uphold law and order in the city. The court noted that the
army has been deployed under Article 245 to assist in maintaining peace,
indicating the seriousness of the situation.
Furthermore, the court reiterated that Section 144 remains in effect in the
capital, thereby reinforcing the prohibition against any form of protest or
gathering. The Islamabad High Court’s ruling underscores the government’s
commitment to ensuring a peaceful and secure environment during the SCO
Summit.
