PESHAWAR: The Supreme Court, in a major decision, reinstated 16,000 dismissed government employees. However, employees from grad 8 to 16 have to clear the departmental test and will be considered ad-hoc workers till the test result is announced.
A five-member larger bench of the apex court headed by Justice Umar Ata Bandial delivered its verdict on the review appeals for reinstatement of dismissed government employees. The court rejected the dismissed employees’ appeals for review and ordered conditional reinstatement.

Justice Mansoor Ali Shah was the only judge to have disagreed with the majority judgment. His dissenting note has been made a part of the short judgment. The note states that Parliament is supreme in the parliamentary system of government and should make such decisions. While the other four judges accepted the government’s suggestions, saying that the employees recruited from 1993 to 1996 have been rehabilitated using the powers of Article 184, Clause 3 and 187.
The judgment said that the employees fired for corruption and misconduct will not be reinstated. A detailed verdict on the review appeals against the dismissal of government employees will be issued later. The written decision further said that the rehabilitation and promotion of the employees would be in accordance with the rules and regulations of the departments.
The Attorney General Khalid Javed Khan said that the Federal Public Service Commission will complete the test of employees in three months, the employees who pass the test will be reinstated on a permanent basis. The amount paid to the employees will not be recovered.
